Our terms and conditions

These terms govern your use of BlixtAI at https://www.blixtai.com. By creating an account or using the service you agree to them. If you are agreeing on behalf of an organisation, you confirm that you may bind that organisation.

The service

BlixtAI takes laboratory test results that you supply and produces written test reports from them, including suggested treatment options, alternatives, and the sources behind them. We may change, add to, or withdraw features over time.

Clinical responsibility

Our reports are decision support. They are not a diagnosis, not a prescription, and not a substitute for professional judgement. Every report must be reviewed by a suitably qualified clinician or pharmacist before it is relied on or released. Treatment decisions remain yours, and must account for the full clinical picture including culture and susceptibility results, infection site, severity, allergies, renal and hepatic function, drug interactions, your local antibiogram and formulary, and current institutional guidance.

Generated content may be incomplete or wrong. You are responsible for checking it before it reaches a patient record or a patient.

Your account

Give us accurate details and keep them current. Keep your credentials secret, and tell us promptly if you think your account has been compromised. You are responsible for what happens under your account, including anything done by people you invite to it. You must be old enough to enter a contract where you live.

Your data and how you may use the service

You keep ownership of everything you upload. You grant us only the permission needed to host and process it in order to provide the service to you.

You agree that you will not:

  • upload health information you are not authorised to handle, or use the service in breach of the laws that apply to that information;
  • use the service to provide care without qualified clinical review;
  • attempt to access another customer’s data, or probe, scan or interfere with the service or its security;
  • resell or redistribute the service, or use it to build a competing product;
  • place unreasonable load on the service, or evade usage limits or billing.

Fees and billing

Plans, allowances and per-report rates are set out on our pricing page. Subscription fees are billed monthly in advance and usage beyond your allowance is billed in arrears on your next invoice. Fees are exclusive of taxes, which we add where required.

You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are not refunded except where the law requires it. We may change our prices, and will give you notice before a change affects you. If an invoice goes unpaid we may suspend the account.

Availability

We work to keep the service available but do not promise that it will be uninterrupted or error-free. We may suspend it for maintenance, or where we reasonably believe it is being misused or that doing so is necessary for security or legal reasons.

Intellectual property

The service, its software and its branding belong to us. These terms give you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing, and nothing more. Reports generated for you are yours to use in your practice.

Third-party services

We rely on third parties for hosting, storage, payments, email and report generation. Their failures may affect the service, and we are not responsible for their own acts or omissions.

Disclaimers and liability

To the fullest extent the law allows, the service is provided “as is” and we exclude all implied warranties, including fitness for a particular purpose and any warranty as to the accuracy or clinical suitability of generated content.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, nor for lost profits, lost data or clinical outcomes; and our total liability arising out of the service is limited to the fees you paid us in the twelve months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.

Indemnity

You agree to indemnify us against claims arising from your use of the service in breach of these terms, from data you upload without authority, or from clinical decisions taken on the basis of a report.

Suspension and termination

You may close your account at any time. We may suspend or close an account that breaches these terms, that is used unlawfully, or where we are required to. On termination your right to use the service stops; we will make your data available for a reasonable period before deleting it, as described in our privacy policy.

Changes to these terms

We may update these terms. We will change the date at the top of this page and, where a change is significant, tell you directly. Continuing to use the service after a change means you accept it.
